General:

Imbizi Safaris (“the Company”) is incorporated in Namibia. The company is a full member of NTB (The Namibia Tourism Board) and TASA (Tour and Safari Association of Namibia) and provides safari services in Namibia. The provision of our services is subject to the company's General Terms and Conditions set out below, which clients and/or agents on behalf of their client (herein after referred to as “the Client”) should read carefully as they set out the respective obligations of the company and the Client and form, together with the booking confirmation form, the basis of the contract between the Company and the Client. By signing and returning the Company’s booking confirmation form, the Client confirms acceptance of these terms and conditions. Clients must accept that conditions in Africa are not the same as those in developed countries and standards of service, medical facilities, safety and security, amongst other things, may be lower than those in their home countries.

Tour arrangements are intended for persons of reasonably good mental and physical health and without physical disabilities, which would create a hazard either for the Client or other passengers. By singing and returning the Company’s booking confirmation form, the Client certifies that he or she does not have any physical or mental disability that might create a hazard for themselves or other tour participants. The Company reserves the right to decline to accept or retain any person as a tour participant should such person’s physical or mental condition impede the operation of the tour. The Client shall not be entitled to any refunds.

Jurisdiction:

The company is incorporated in Namibia and it operates under the laws of Namibia. All contracts with Clients and matters/disputes arising out of such contract, any of our brochures or any of our tours will be governed by the laws of Namibia, and any litigation involving such contract, can only be brought in courts of competent jurisdiction in Namibia.

Booking process:

1.
For reservations and/or inquiries, fill in our information form on our website or send us an email at This e-mail address is being protected from spam bots, you need JavaScript enabled to view it We will respond to your request as soon as possible. Reservations will be confirmed by us through email.

2.
Subject to clause 5 below, reservations will only become confirmed bookings:
- once a Client has signed and returned our booking confirmation form; and
- once a Client has paid the tour price and payment transaction costs in full; and
- once the company has proof of such payment.
The company considers as proof of such payment:
- when the Client has signed and returned our creditcard/debitcard authorisation form; or
- when we have received the total amount due on our bank account.
Note that our confirmed booking policy is based on a first come first serve principle.

3.
Full payments or deposit payments can be made by bank wire transfer and by creditcard/debitcard authorisation. Note that the Client is responsible for the transaction costs involved in each payment. Any payments by cash can only be made at the Imbizi Safaris office in Namibia.

4.
The tour price and payment transaction costs should be paid in full at least 6 weeks (42 days) before the arrival of clients.

5.
Confirmed bookings within 6 weeks (42 days) of the tour must be paid in full.

6.
If you are paying with credit/debit card, the balance due will be charged to your card at the appropriate time as set out herein.

7.
In the result of a cancellation of a confirmed booking, the onus rests on the client to recover any monies paid to any third party.


8.
a) On receipt of payment we will send safari information and, in case of self drive safaris, vouchers. Please ensure that you receive this information before you leave on safari.
b) The client who signifies the acceptance of a booking does so on behalf of himself/ herself and persons under his/her authority, and warrant that he/she has authority to enter into a contract on behalf of the other person included in such a booking and in event of the failure of any or all the other persons so included to make payment, the person making the booking shall by his/her signature thereof assume personal liability for the total price of all bookings made by him/her. All bookings are made with the Company and no person has any authority on its behalf to vary any of the terms and conditions which are applicable.

Note: Confirmed bookings should be made well in advance as some accommodations are limited in size, and sell out well in advance due to seasons. To assure your first choice of accommodation, an early confirmed booking is essential.

Consent:

The payment of any deposit or any other partial payment for a reservation on a safari constitutes consent by the Client or any member of his/her party covered by that payment to all provisions of the conditions and general information contained on this website, literature or information sources whether the Client has signed the booking form or not.

Cancellation conditions and charges:

We will always endeavour to avoid cancelling a confirmed booking, but we retain the right to do so.
We reserve the right to cancel your confirmed booking less than 6 weeks (42 days) prior to your departure if:
(a)
you have failed to make all payments due in full and within the time frames set out in these terms and conditions; or
(b)
we are forced to do so as a result of unlikely and/or unforeseeable circumstances beyond our control including, but not limited to, lack of resources, the consequences of which we could not have avoided even with all due care taken.

In the unlikely event of (b) above, the Company will inform the Clients without delay and will make every effort, but have no obligation or liability, to offer a comparable alternative. If the chosen alternative is less expensive than your original tour, we shall refund any difference paid to you but if it is more expensive, you shall assume the responsibility for the difference in cost and make payment within 24 hours of accepting such revised price. Alternatively you are entitled to a full refund of all monies you have paid to us.

Except where we cancel for reasons other than those mentioned in this clause, the Company shall have no further liability to you. We regret we cannot pay any expenses, costs or losses incurred as a result of any cancellation, and advise that it is your responsibility to ensure that such costs and losses are covered by your travel insurance.

The client undertakes and agrees that he/she will, at all times, comply to a reasonable code of conduct during the safari and will not in any way constitute a nuisance to the other persons on tour. We reserve the right, without prior notice, to terminate the tour of any person(s) in any party if, in our reasonable opinion or in the opinion of any other person of authority within the realms of our organization, the person(s) concerned behave in such a way to cause or be likely to cause any danger, annoyance or distress to any third party or damage to property. In such a situation, the person(s) concerned will be required to leave the accommodation or other service immediately. We shall have no further responsibility towards such person(s). No refunds will be made for any unused services and the Company shall not pay any expenses or costs incurred as a result of such termination.


Cancellations by Client
Should you or any member of your party wish to cancel a reservation or confirmed booking, you must notify us in writing. A verbal cancellation is not effective and cancellations will only come into effect when we receive your instructions to cancel your tour reservation or your confirmed booking in writing. An emailed or faxed instruction to cancel your tour reservation or confirmed booking would suffice. Please note that any deposits paid are always non-refundable.
Should you or any member of your party not show up for a tour, it will be regarded as a last minute cancellation and this cancellation policy will come into effect as well.

Cancellation of confirmed bookings
To cover our estimated loss caused by the cancellation of a confirmed booking and as we may be unable to resell your tour, cancellation fees, excluding travel insurance premiums, will be levied per person as follows:
Period before departure cancellation charge (as percentage of total price paid where applicable).
a)
10% with a maximum of 2.500 N$ per person fee will apply for cancellations made 90 days or more prior to departure.
b)
30% of total tour price is forfeited for cancellations made between 89 and 65 days prior to departure.
c)
50% of total tour price is forfeited for cancellations made between 65 and 43 days prior to departure.
d)
100% of total tour price is forfeited for cancellations made 42 days or less prior to departure.
e)
Plus applicable third party charges.

We strongly recommend cancellation insurance, as set out below under “the heading “Insurance.

Refunds
a)
No refunds are given for unused services or portion of a tour.
b)
No refunds will be given to clients who do not complete a tour for any reason whatsoever.
c)
No refunds will be made for circumstances arising beyond the control of the company necessitating alternative arrangement to ensure safety or further participation and/or enjoyment of a tour.
d)
No refunds will be made for lost time or substitution of advertised facility/accommodation. Any alternative accommodation will be of the same, if not a better standard.
e)
No refunds will be made for itineraries amended after departure.

Changes to the Scheduled Tours:

Alterations to confirmed bookings can be made by mutual agreement and at extra cost. The exact amount will depend on the alteration and will include penalties of such alterations imposed on us by our suppliers.

Our scheduled tours are planned many months in advance and sometimes changes may be necessary. Thus, although we would normally expect to be able to provide you with the services confirmed by us in respect of your original booking, the Company reserves the right to alter arrangements to a scheduled tour should conditions necessitate.
The Company reserves the right to alter your tour routing at any time in the event that the Company or its suppliers deem your safety to be a concern.
In the event of mechanical failure, sickness, weather, political unrest or any other conditions, the Company reserves the right to change or cancel any part of the advised itinerary.
In the event that your tour arrangements are altered or cancelled, no compensation shall be provided.

Insurance:

Comprehensive travel and medical insurance is compulsory for the duration of the tour. The client acknowledges that it is his responsibility to take insurance. The client undertakes to take comprehensive travel insurance to cover his/her personal requirements. This insurance should include cover in the respect of, but not limited to, the following eventualities: personal injury, illness or death, cancellation and curtailment of the safari and services booked, emergency evacuation expenses, medical expenses, repatriation expenses, damage/theft/loss of [personal baggage, money and goods. Activities with a greater inherent risk, such as animal tracking on foot, should be covered. The Company, including their representatives, employees and agents will take no responsibility for any costs, losses incurred or suffered by the guests, or guest's dependants or traveling companions, with regards to, but not limited to, any of the above mentioned eventualities. Guests will be charged directly by the relevant service providers for any emergency services they may require. Please note that credit card travel insurance is inadequate for a safari.

Travel documents & health certificates:

Every Client must be in possession of a current passport valid for at least six months from the date of departure, round-trip airline ticket, and have adequate funds for the duration of the stay. It is the Clients responsibility to take proper medical and practical precautions both prior and during the Clients tour. Obtaining a passport and health certificate with the required inoculations is the responsibility of the Client. Details of visa/health requirements can be found on our website.

Accommodation:

The standard pricing policy is based on a twin room being shared by two people. A single room will be provided on request at a supplementary cost but cannot be guaranteed.
Hotel and lodges are named as an indication of category and rooms may be reserved at similar hotels and lodges.

Transportation Imbizi Safaris Guided Tours:

Although every effort is made to ensure that vehicles provided for the specific itinerary of an Imbizi Safari guided tour are provided in a good condition, no liability can be accepted for breakdown, or any damage or delay resulting as a consequence. In the event of a breakdown, the company will endeavour to provide a replacement vehicle as soon as it is practical.

Subcontractors:

The Company reserves the right to use the services of sub- contractors for all or part of the services.

The Company can act as an agent for clients in connection with hotel accommodation, camping arrangements, (sightseeing) tours, activities and all kind of transportation (other than the tour or transportation provided and operated directly by the operator itself).  The Company will use due diligence in so acting,  but subject to that, shall be under no liability in respect of any matters howsoever arising in connection with such hotel accommodation, camping arrangements, (sightseeing) tours, activities and transportation.  Arrangements so made by the Company will be subject to any special terms imposed by the hotel or site owners, tour providers, activity providers or providers of transport.

The Company shall not be liable for delays in, deviations or omission from any tour or route howsoever caused, or for direct consequences thereof.  When in the opinion of the company representative it is necessary in the interest of safety or for the satisfactory continuation or termination of a tour to incur extra expense, the operator may do so and recover the same from the clients. The same applies to activities and transportation.

Clients together with their personal property including baggage are all times solely at own risk.

Clients will accept the authority and decision of the compagnies employees and agents during a tour.

Prices:

a) Prices are quoted in the currency specified in the quote and are applicable at the time of printing. A quotation is valid for 14 days only.

b) Prices are subject to change due to fluctuations in exchange rates, fuel costs, tariffs, taxes, etc. We must reserve the right to make such changes and thus increase the tour price.

c) Price Includes/Excludes: this will be specified during your specific booking.

Baggage:

Baggage is restricted to one standard size soft bag of 15 kgs or less, due to limited space on the vehicle.

Information:

Information on brochures, website or any other publication is to the company’s best knowledge and belief correct at the time of printing but the company reserves the right to make changes without notice.
The descriptions, information and opinions given by the company are given in good faith, based on the latest information available to the company. The company cannot accept any responsibility or liability for any errors or omissions.
The information given in the tour itineraries regarding drive times are estimates and may differ due to events that may occur along the way.

Special Requests:

Any special request or requirement which is essential to your booking, such as specific dietary requirements, must be made known to us in writing before you book. When failing to do so, the company shall have no liability for changes in the cost of the safari or lack of availability of the required item.

Promotions:

By signing and returning our booking confirmation form, you give full right to the use, for promotional purposes, of photographic images of you and/or other members of your party whether still pictures or video, taken on safari. 

Authority on safari:

Clients will accept the authority and decision of the Compagnies employees and agents during a tour.

Age limits on safari:

Please consult us regarding age policies at the time of booking. The regular age limit is 12 years at the time of participating on the tour. In the event of any participant being under the regular age limit, we reserve the right to terminate the safari for that particular participant without compensation.

Force Majeure:

We regret that we cannot accept any liability or pay any compensation where the performance or proper performance of our obligations is prevented or affected by any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events include war or threat of war, riots, civil strike, border closures, refusal of visa for entry, unexpected government acts, terrorist activity, political disputes, industrial disputes, natural or nuclear disaster, extreme weather conditions, fire, technical and/or mechanical problems to transport, delayed flights, road closures, disease and all similar events beyond our control.

Liability:

The company provides its services to the best of its ability in comfort and safety but it should however be understood that all travel is undertaken at the risk of the client. Such risks include injury, disease, loss or damage of property, discomfort or inconvenience etc.

The company reserves the right to employ subcontractors for certain services. These will be liable for the part of service they provide and according to their own terms and conditions.

We shall make every reasonable effort to ensure that all components of the safari are supplied as described on our website and to a reasonable standard; and our employees, agents, suppliers and sub-contractors exercise due care in carrying out our obligations under the contract. This acceptance of responsibility is subject to the clause relating to "Force Majeure" above and these Terms and Conditions. Our maximum liability in respect of complaints is limited to an amount equal to the cost paid by or on behalf of the person affected for the relevant services. The maximum amount will only be payable where the person affected has derived no benefit from the safari and none of the services contracted have been provided. Any claim must be notified to us in accordance with the complaints procedure set out below. Any person to whom any payment is made (and their parent or guardian if that person is a minor) must assign to the company and the company's insurers any rights they may have to pursue any third party in connection with the claim and provide all necessary assistance to the company and our insurers that be reasonably required.

Customer Complaints:

Customer complaints must be reported immediately to your tour guide or to the Company office, who will do their best to resolve any problem. In the unlikely event that you remain dissatisfied, a written report should be submitted to The Company situated at the address below as soon as possible after the incident to enable us to complete a full investigation. Complaints not specifically reported while on tour cannot be entertained. Regrettably, liability for any complaints not notified in accordance with this procedure cannot be accepted.

Disclosure Notice:

Please be aware that during your participation in an Imbizi safari tour, certain risks and dangers may arise including, but not limited to, the hazards of traveling in undeveloped areas, exposure to potentially dangerous animals, travel by boat, train, automobile, aircraft or other means of conveyance, the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities.
Also be aware and clearly understand that the Company will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. You are voluntarily participating in these activities with the knowledge of the dangers involved and hereby agree to accept any risks.
As lawful consideration for the agreement with the Company to participate in such trips and activities you hereby agree that you will not make a claim against the Company or sue for bodily injury, emotional trauma, death and/or property damage, however caused, as a result of your participation in the safari tour. You therefore indemnify and agree to hold the Company and its employees harmless from any and all claims, known or unknown, arising from your participation in a tour. This release of Liability and Assumption of Risk agreement is entered into on behalf of all members of your family including minors accompanying you. This agreement is binding on your heirs, legal representatives and assigns.
If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect.
